Terms of Service

These Terms of Service ("Terms") govern your use of bmwpasoft.com and any purchase from BMW SCANNER PASOFT ("we", "us", "our"). By using this site or placing an order, you agree to these Terms. If you do not agree, do not use the site or purchase our products.

1. Products and intended use

We sell BMW diagnostic hardware, software and accessories intended for use by vehicle owners and technicians on supported BMW chassis (E46, E39, E38, E83, E53, E52, E85, plus E36 and E34 with limited functions for PASOFT products, and 20-pin-connector models for the OBD1 adapter). You are responsible for confirming compatibility with your vehicle and computer before purchase. Product descriptions are provided in good faith; minor differences in packaging or appearance may occur.

2. Use at your own risk

Diagnostic, coding, EEPROM and programming functions can change how vehicle modules operate. You use our products entirely at your own risk. You are solely responsible for backing up data, following correct procedures, and any changes made to your vehicle. We are not responsible for damage to vehicles, modules, keys, immobilizer (EWS) systems, computers or data resulting from use or misuse of our products. Do not use our products while driving or in any way that violates the law, including odometer laws.

3. Software license

Software is licensed, not sold. Upon purchase you receive a personal, non-exclusive, non-transferable license to use the software with your PASOFT interface. You may not copy, resell, share, distribute, reverse engineer, crack or modify the software or license, except as permitted by law. We may revoke the license for violation of these Terms.

4. Orders, pricing and payment

All prices are in U.S. dollars and may change without notice. We may refuse or cancel any order, including for suspected fraud, pricing errors or unavailable stock; if we cancel a paid order, we will refund the amount paid. Payment must be received in full before an order ships.

5. Shipping and risk of loss

Delivery times are estimates and not guaranteed. Risk of loss passes to you when the carrier confirms delivery to the address you provided. You are responsible for providing an accurate shipping address.

6. Returns and refunds

All sales are final except as described in our Refund Policy, which is incorporated into these Terms.

7. Support

Remote setup support is provided as a courtesy to help install and connect your product. Support is offered on a reasonable-efforts basis, by appointment, and does not include vehicle repair advice or guarantee any particular result.

8. Disclaimer of warranties

Except as expressly stated in our Refund Policy, products and software are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the software will be error-free or work with every vehicle configuration.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, including vehicle damage, lost data, lost profits or repair costs. Our total liability for any claim relating to a product or these Terms will not exceed the amount you paid for that product.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages and expenses (including reasonable attorneys' fees) arising from your use or misuse of our products or your violation of these Terms or any law.

11. Trademarks

BMW and related model names are trademarks of Bayerische Motoren Werke AG. We are an independent seller and are not affiliated with, endorsed by or sponsored by BMW AG. Model and chassis names are used only to describe compatibility.

12. Chargebacks and disputes

Please contact us at info@bmwpasoft.com before filing a payment dispute so we can try to resolve it. Filing a chargeback for a delivered, working product may result in revocation of any software license associated with the order.

13. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

14. Changes

We may update these Terms at any time by posting the revised version on this page. Changes apply to orders placed after the update.
